Did you know that in NSW, the law requires you to have a Contract of Sale prepared before you can even market the property?

What is a Contract of Sale?

A Contract of Sale is a legal document prepared by a solicitor, governed by the Sale of Land Regulations 2017 detailing every aspect of the transaction.

Important information must be disclosed or else the purchaser will have the right to cancel the contract without any consequences:

  • Whether your swimming pool complies with Swimming Pools Act 1992
  • Detailed list of every By-Law for your Owners Corporation if the property
  • Whether land tax is payable for your property
  • Whether you have established a good chain of title for your property if it is or was old systems title

What is conveyancing?

Conveyancing is the process where the legal title of a property is transferred from one party to the other.

Conveyancing is divided into three stages:

  • Pre-contract - where the contract is reviewed and the property is investigated
  • Pre-settlement - where documents are prepared to enable the transfer of ownership, stamp duty is paid and the bank comes on board to provide the funds
  • Post-settlement - where government bodies are notified of the change of ownership

Our Service

Conveyancing has moved from the traditional paper based settlements into an online and secure platform known as Property Exchange Australia (“PEXA”). PEXA become compulsory for all transactions in NSW last year and we have used the platform for the last five years.

We work closely with verification of identity partners to ensure your property transaction is as secure and seamless as possible. We will help you navigate the stamp duty process, assist you with statutory declarations and help you stay on top of the finance process.
